Terms of Service
1. Acceptance of Terms
By accessing or using Toast & Fig Jam ("I," "me," "my," or "the Service"), a personal wellness and reflection project created and operated by an individual, you agree to be bound by these Terms of Service.
If you do not agree, please stop using the Service immediately.
2. Nature of the Service
Toast & Fig Jam provides self-reflection, wellness, and clarity-oriented tools intended for personal exploration and insight.
The Service does not:
- provide medical, psychological, or therapeutic advice
- diagnose, treat, or prevent any condition
- replace professional mental or physical health care
- claim to produce any guaranteed outcome
State readings, including Survival, are reflective labels only. They are not diagnostic assessments and are not a substitute for professional evaluation, crisis support, or emergency care.
You agree not to use or cite any state reading, including Survival, as a reason to delay, avoid, or decline emergency care, crisis support, or professional mental or physical health care when you may need it.
You acknowledge that the Service is creative, reflective, and exploratory in nature and that you use it voluntarily and at your own discretion.
3. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or guardian.
4. User Responsibilities
You agree that you will not:
- misuse, interfere with, disrupt, or harm the Service
- attempt to access data not intended for you
- use the Service for unlawful, abusive, or harmful purposes
- attempt to reverse-engineer, scrape, replicate, or extract proprietary systems or scoring logic
- submit harmful, offensive, or malicious content
You are responsible for the security of your device and any information you submit.
5. Intellectual Property
All content, language, frameworks, scoring logic, visuals, UX structures, reflections, and branding within Toast & Fig Jam are original intellectual property owned by me as the creator.
You may not copy, modify, distribute, publish, commercialize, or create derivative works from any part of the Service without written permission.
You may use the Service only for personal, non-commercial purposes.
6. Privacy & Data
Your use of the Service is also governed by the Privacy Policy, which explains how personal information is collected, used, stored, and protected.
Personal information is handled as described in the Privacy Policy. Where consent is required, Toast & Fig Jam asks for it separately, and you can choose whether to provide it.
7. No Guarantee of Outcomes
You acknowledge that:
- all reflections, insights, and patterns generated by the Service are interpretive and exploratory
- results vary from person to person
- the Service cannot guarantee emotional, psychological, spiritual, physical, or wellness outcomes
- the Service should not be relied on for decision-making requiring professional expertise
You are solely responsible for how you interpret and use the content.
8. Third-Party Tools
The Service may rely on third-party providers for hosting, analytics, email, payment processing, cloud storage, and technical functionality. I am not responsible for issues caused by third-party tools or disruptions outside my control.
9. Availability of the Service
I may modify, update, pause, or discontinue any part of the Service at any time, without notice. I am not liable for downtime, errors, data loss, interruptions, unsupported devices, or inability to access the Service.
10. Paid Subscriptions, Billing, and Account Access
Toast & Fig Jam may offer optional paid subscriptions, including Founding Bio-Harmony access. Paid features are account-based and may require you to be signed in with the email address connected to the subscription.
Founding Bio-Harmony costs $11 per month and has no free trial. Payments are processed by Stripe. Before checkout, you must affirmatively authorize an $11 charge when you join and automatic $11 monthly renewal charges until you cancel. TFJ does not store your full card number.
You can manage or cancel billing from the account billing page, or by emailing support@toastandfigjam.com from the email connected to your account. Cancellation stops future renewal charges. Access continues until the end of the paid period already purchased unless an approved refund ends it sooner.
We will refund your first Founding Bio-Harmony subscription payment when you request it within 7 calendar days of the charge. Renewal charges are nonrefundable except for duplicate or incorrect charges and where required by law. Email support@toastandfigjam.com from the email connected to your account. When a full refund is issued, the subscription is also canceled so another renewal is not scheduled. The Cancellation and Refund Policy provides more detail.
TFJ will not apply a new recurring price or material subscription term to an existing subscription until the required notice and consent process is operational. If a future change is offered, the retainable notice will explain the change, its effective date, how to cancel, and whether fresh consent is required.
If a Stripe subscription can still renew, TFJ will not finish deleting the account until the subscription has been canceled or its cancellation has been confirmed. Stripe may keep financial records as required by law.
11. Termination
I may suspend or terminate your access to the Service at any time for any reason, including misuse or violation of these Terms. You may stop using the Service at any time.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available." I make no warranties, express or implied, regarding accuracy, reliability, expected outcomes, fitness for a particular purpose, or uninterrupted access.
You agree that your use of the Service is entirely at your own risk.
13. Limitation of Liability
To the maximum extent permitted by law:
- I am not liable for any damages, losses, emotional distress, decisions, or consequences arising from your use or inability to use the Service.
- I am not responsible for any unauthorized access, hacking, security breaches, or events outside my reasonable control.
- I do not assume liability for any interpretations, assumptions, or actions you take based on reflections or insights from the Service.
Nothing in this section limits the Cancellation and Refund Policy or consumer rights that cannot legally be waived.
14. Indemnification
You agree to indemnify, defend, and hold harmless me, as the individual creator, from any claims, damages, liabilities, losses, or expenses (including legal fees) arising from your use or misuse of the Service, violation of these Terms, breach of applicable laws, or harm or disputes involving your own actions.
15. Governing Law
These Terms are governed by the laws of the state in which I reside, without regard to conflict-of-law principles. Disputes will be resolved first through informal negotiation, and if needed, through binding arbitration or small-claims court depending on jurisdiction.
16. Changes to Terms
I may update these Terms as the Service changes. TFJ will not apply material subscription or recurring-price changes to an existing subscription until the required retainable notice and consent process is operational.
